With the arrival of the new extensions, it is a virgin market that is opening up with all the terms currently taken under .fr or .com, free under .guru, .email, .boutique, .services, .paris, etc.

Definition of a premium domain name

It is nowadays almost impossible to find common words in the dictionary free .com and .fr. On the secondary market, this type of domain name is highly sought after and can fetch crazy amounts of money.

This is obviously not the case for the extensions that have just been launched, and each registry has drawn up a list of common names of particular value, which cannot be registered during the classic launch periods. These names are called “premium names”. Here are some examples:

-* idees.menu
-* saint-valentin.menu

One would have thought that, just as it was the case in the past (we remember the premium .CO domains sold for several thousand dollars), the registries would take advantage of this to sell their nuggets at very high prices.

The good news is that they have been very reasonable, the extra cost compared to classic domains being generally only a few tens of dollars, thus offering opportunities that we advise you not to miss.

With the new extensions, you add an additional descriptive level to your domain name (idees.menu speaks for itself).

The list of premiums is obviously specific to each extension, a premium in .archi is obviously not necessarily a premium in .bio… They can be registered either during the “landrush” period, or at the time of opening to all, according to the rules specific to each registry/extension.

DPML and premium

Two registries, Donuts and Rightside, propose to block trademarks within their DPML systems on all the extensions that these companies will manage. But DPML does not protect premium terms.

If you have a short or generic trademark or one that may have meaning in another language, then your domain name will be registrable by a third party for a few euros more than when it was opened to all.

You may be able to live with cybersquatting, but it’s important to stay informed

The sheer number of TLDs makes comprehensive protection an impossibility. The procedures implemented by ICANN (Trademark Clearinghouse) and by several registries (e.g. Donuts DPML) can provide savings on certain costs. However, the cybersquatting risk remains slightly higher, and setting up monitoring services is now the only way to stay up-to-date so that you can act on any infringements to your trademarks.

DPML - MPML - TREX - Uni EP: what about these protection systems?

Since the launch of the new TLD programme in 2012, several systems for protecting trademarks via domain names have emerged: some have endured, others are emerging or dying.

In the space of a year and a half, this market has evolved: SafeBrands wanted to give an update on the evolution of each protection system.

The DPML is still there and even MORE!

DPML is the protection system proposed by Donuts that allows to block a term, corresponding to a trademark declared in the TMCH database, under all the extensions managed by the registry, the list of which is available on the Donuts website.

At the end of 2016, Donuts had launched DPML Plus, a reinforced protection system of the traditional DPML. Originally, this product was intended to be a short-lived product, for the duration of a marketing operation. After reflection and market demand, DPML Plus became a permanent product.

At the end of 2018, there are two things to remember about Donuts DPMLs:

Effective from 17 September 2018, Donuts offers a new product, included as standard in DPML and DPML Plus: ‘Homograph Protection’. The system is based on the Unicode standard and the associated internationally used mapping table.
An increase in the price of DPML and DPML Plus from 1 January 2019: the registry justifies this increase by adding new TLDs to its list: recovery of the management of .TRAVEL, merger of Donuts & Rightside etc.

The end of life of the MPML

MPML is another protection system proposed by the Minds & Machines registry. During the last Icann Meeting held in Barcelona at the end of October 2018, the announcement was made: the MPML is doomed to disappear! It can no longer be renewed and/or registered.

What happens to the extensions benefiting from the MPML? As time goes by, MPMLs will have to be migrated on a case-by-case basis under TRex, the new protection system that covers MPML TLDs but not only…

TRex: the new protection system proposed by the TMCH

The Trademark Clearinghouse – TMCH – was set up to protect trademark holders as part of ICANN’s new TLD programme in 2012. Its purpose is to centralise your trademark data in view of priority registrations of your domain names and to alert you in case of a similar application filed by a third party.

At the end of September 2018, the TMCH developed a new service, called TRex (Trademark Registry Exchange), which provides an additional layer of protection, working on the same principle as the DPML Plus. At present, TRex covers 40 extensions:

.BAYERN, .BEER, .BOSTON, .CAPETOWN, .CASA, .CAT, .COLOGNE, .COOKING, .DE, .DURBAN, .EARTH, .EUS, .FASHION, .FISHING, .FIT, .FRL, .GARDEN, .HORSE, . JOBURG, .KOELN, .LA, .LONDON, .MIAMI, .MOE, .NRW, .OSAKA, .QUEBEC, .RODEO, .RUHR, .SCOT, .SURF, .TIROL, .TUBE, .VIP, .VODKA, .WEDDING, .WIEN, .WORK & .YOGA.

Coverage will increase: the TMCH intends to expand the scope of TRex each year by adding new TLDs, which will not be limited to new gTLDs but will also include ccTLDs and legacy TLDs.

Any purchase of the TRex service must be done through a TMCH accredited agent, as is SafeBrands.

Uni EP: Uniregistry’s future protection system

Uniregistry is planning to launch its protection service called Uni EP (temporary name of the product), inspired by Donuts’ DPML. Currently under development, Uniregistry hopes to launch its service by Q1 2019, at the latest, Q2 2019.

For information, Uniregistry’s current portfolio includes 26 extensions:

DPML DONUTS

Some registries that manage a large number of these extensions have implemented alternate solutions. Donuts’ DPML (Domain Protected Marks List) is one of them and it covers over 240 TLDs.

WHAT IS THE DONUTS DPML?

Protect your brand on the Internet with Donuts’ DPML. DPML is the acronym for Domains Protected Marks List. DPML applies only to extensions sold by Donuts.

This service is only available if you have registered your trademark with the TMCH database. It allows you to block your domain name’s registration with the new extensions constantly entering the market.

This service proactively blocks the registration of all domain names that partially or completely include your brand name. This gives you a truly preventive brand protection strategy, defending your online reputation and protecting your business from possible attacks before they happen.

With DPML, your trademark is entered in the list of non-registrable domain names.

 

Why sign up for the Donuts DPML?

Since the new extensions were launched in 2012, Donuts has applied for over 300 new gTLDs with the hope of obtaining at least 200: it reached its objective in 2019 as it manages 247 of them.

The DPML services (for Domains Protected Marks List, sometimes called Donuts Protected Marks List) were introduced to allow owners to protect their trademarks (exact name or variants) by blocking the associated domain names in all the TLDs managed by Donuts.

They protect trademark owners against cybersquatting at a lower cost than defensive registrations.

 

HOW DPML WORKS

A trademark must be registered with the TMCH (Trademark Clearinghouse) to be eligible for these solutions. Once listed in a DPML, all domain names with this trademark will be blocked under all extensions managed by Donuts. The initial coverage is 5 years for DPML and 10 years for DPML Plus, renewable for 1 to 10 years in Donuts’ case. But what is the difference between DPML and DPML Plus?

THE OTHER TRADEMARK PROTECTION SYSTEMS

UNI EPS

In the first half of 2019, Uniregistry launched its own online brand protection service with its Uniregistry Extended Protection Service, also known as Uni EPS.

WHAT IS UNI EPS?

Uni EPS allows trademark owners to block terms they have registered with the Trademark Clearinghouse (TMCH) across the entire Uniregistry top-level domain portfolio. The initial offer included all 23 Uniregistry TLDs with a plan to add additional TLDs in the future. However, the registry sold all its portfolio TLDs and thus, 13 new TLD owners decided not to support UNI EPS system.

Only the 10 following TLDs remain protected from June Ist , 2021 : .click, .country, .gift, .help, .hiphop, .hiv, .juegos, .link, .sexy, .tattoo.

The following ones are not supported anymore : .audio, .blackfriday, .christmas, .diet, .flowers, .game, .guitars, .hosting, .lol, .mom, .photo, .pics, .property.

 

Why sign up for Uni EPS?

Just like online brand protection services such as TREx, DPML or AdultBlock, a Uni EPS block will protect a validated brand across 10 extensions managed by Uniregistry. In other words, this means that no one other than the owner of a trademark can register that specific term in these extensions.

Blocking a term is a much cheaper defensive approach than the actual registration of all domains, especially since the block covers premium domain names. Of course, the trademark owner can unblock a specific domain and start using it at any time.

 

HOW UNI EPS WORKS

A trademark must be registered with the TMCH (Trademark Clearinghouse) to be eligible for these solutions. Once registered with Uni EPS, all domain names with this trademark will be blocked under all extensions managed by Uniregistry. The initial coverage is 1, 3, 5 or 10 years (also for service renewal), whether for Uni EPS or Uni EPS +. But what is the difference between the two Uni EPS services?

TREx

The Trademark Registry Exchange—or TREx—is a service developed by the Trademark Clearinghouse offering trademark owners an additional layer of protection for domain names.

WHAT IS TREx?

he Trademark Clearinghouse—or TMCH—has signed an agreement with individual registry operators who wish to offer an additional layer of protection to trademark owners under their TLDs.

Through the TMCH interface, TREx protection for trademark owners is executed as a single product across a set of different TREx TLDs.

The TRex service is available to owners of a trademark registered with the TMCH. Coverage will increase in phases as the TMCH will continue to enhance the reach of TREx yearly by adding additional TLDs. These will not be limited to new gTLDs but will also include ccTLDs and legacy TLDs.

 

HOW TREx WORKS

The TREx service is only available for registrations of sunrise-eligible TMCH trademarks registered through a TMCH agent. However, coverage will increase in phases as the TMCH will continue to enhance the reach of TREx yearly by adding additional TLDs. These will not be limited to new gTLDs but will also include ccTLDs and legacy TLDs.

TREx limits the exposure of a brand name that is generally available under certain TLDs. It does not cover names that are already registered when the service is activated. Similarly, it excludes premium names or names reserved for registration by the registry. However, the TMCH will inform you of the applicable coverage before you subscribe to the service.

The service covers all four ICM Registry TLDs – .XXX, .SEX, .ADULT and .PORN.

Trademark holders with a Signed Mark Data (SMD) file from the Trademark Clearing House (TMCH) and .XXX Sunrise B holders are eligible to block their labels.

Yes, both AdultBlock and AdultBlock+ will block all available domains irrespective of price point and automatically block any additional dropped names while the block service is in place – no further actions are required by the trademark holder.

 

Ask us. We can take a SMD file or a plain text trademark and have access to a system which will provide a list of domains blocked along with any exceptions (domain names currently registered and which cannot be blocked but will be automatically added if they become available while the block service is active). We can provide you with this list.

No, domains that are currently registered cannot be blocked. Once a name is deleted or expires, the blocking service will automatically add the domain name to the list of blocked names during the service period without any further actions.

Once the redemption period has ended and the domain name becomes available, both the AdultBlock and AdultBlock+ service will add the newly available domain name to the block for the remainder of the service period. Registered names cannot be blocked until they become available.

Once a domain name is blocked by the AdultBlock or AdultBlock+ service no other users can register the domain name during the service period.

The variants generation software utilizes Unicode Consortium standards. This means that the AdultBlock+ service not only blocks characters available today but also includes any language character sets that become available in the future for the specific TLD. Currently, the AdultBlock+ service covers over 20 languages and scripts including Chinese (Simplified & Traditional), French, German, Italian, Korean, Portuguese, Russian.

Yes, the AdultBlock+ service will block confusingly similar characters, such as replacing an “L” with a “1” and an “E” with a “3”. The AdultBlock+ service is the most complete coverage available.

The number of variants can be large depending on the trademark. For example, ʻbankʼ would generate thousands of variants. For this reason, we typically provide just a sample of the variations covered by the AdultBlock+ service.

The service allows 1, 3, 5 and 10 year registration periods with a maximum registration period of 10-years for both the AdultBlock and AdultBlock+ service.

Renewals mirror the registration periods with 1, 3, 5 and 10-year renewal options with a maximum registration period of 10-years.
